1. Services Provided

Kitlance Digital provides web design, development, digital marketing, SEO, and related consulting services. The specific scope of work, deliverables, timelines, and pricing will be outlined in a separate Proposal or Statement of Work (SOW) provided to you before a project begins.

2. Client Responsibilities

To ensure your project runs smoothly and stays on schedule, you agree to:

  • Provide all necessary content, branding assets, logins, and materials required for the project in a timely manner.

  • Review deliverables and provide consolidated feedback or approvals within the timeframes specified in your SOW.

  • Acknowledge that delays in providing assets or feedback may result in project delays and shifted deadlines.

3. Payment Terms

  • Deposits: Most projects require a non-refundable deposit before work commences, with the remaining balance tied to specific milestones or final delivery.

  • Invoicing: Invoices are due upon receipt unless otherwise specified in your SOW.

  • Late Payments: We reserve the right to pause work or withhold final deliverables, site launches, or asset transfers until outstanding invoices are paid in full.

  • Refunds: Due to the custom nature of our design and marketing work, we do not offer refunds on services already rendered or time already spent.

4. Revisions and Scope Creep

We want you to love the final product. Your SOW will outline a specific number of revision rounds included in your project. Any additional revisions, feature requests, or changes outside the original scope of work will be billed at our standard hourly rate or quoted as a separate project.

5. Intellectual Property & Ownership

  • Client Rights: Upon final payment, you will own the rights to the final website design, graphics, and written content created specifically for your project.

  • Pre-Existing Materials: We retain ownership of any pre-existing code, frameworks, or proprietary tools used to build your project, but grant you a license to use them as part of the final deliverable.

  • Portfolio Rights: We reserve the right to showcase the completed work in our agency portfolio, on our website, and across our social media channels for promotional purposes.

6. Disclaimer of Warranties and Results

While we utilize industry best practices for all web design and digital marketing campaigns, the digital landscape is unpredictable. We cannot guarantee specific business outcomes, search engine rankings (SEO), sales, or traffic numbers. Services are provided “as is” without any warranties, express or implied.

7. Limitation of Liability

To the maximum extent permitted by law, Kitlance Digital and EOD Support LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of your use of our services or website.

8. Termination

Either party may terminate a project with written notice if the other party breaches these terms and fails to correct the breach within 14 days. If you choose to terminate a project early, you will be billed for all work completed up to the date of cancellation, and the initial deposit remains non-refundable.

9. Governing Law
